ArtifactVerify – Terms of Service

Welcome to ArtifactVerify (“ArtifactVerify,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of ArtifactVerify’s website, AI-driven artifact analysis services, and public verification pages (collectively, the “Service”).

By using the Service, you agree to these Terms. If you do not agree, you may not use the Service.

1. Overview of the Service

ArtifactVerify provides AI-assisted analysis of user-submitted artifact images, including:

PointCheck – Full Analysis
PointCheck – Quick Image Check

The Service evaluates visible lithic characteristics in uploaded images and generates:

authenticity probability assessments
typology classifications
descriptive observations
optional downloadable PDF reports
optional public verification pages accessible via QR codes

Important:

ArtifactVerify does not provide guaranteed authentication and does not replace a professional human examination.
All results are AI-generated and are based solely on the images submitted by the user.

2. Eligibility

You may use the Service only if:

you are 18 years or older, or
you are under 18 but have the consent of a parent or legal guardian

By using the Service, you represent that you meet this requirement.

3. User Responsibilities

You agree to:

only upload images you have the rights to use
not upload illegal, harmful, or misleading content
not attempt to reverse-engineer, abuse, or disrupt the Service
follow all applicable laws when using our AI-generated output (eBay policies, marketplace rules, etc.)

You are solely responsible for how you use the AI analysis, including any claims you make when listing artifacts for sale.

4. Payments, Billing & Refund Policy

Payments are processed securely by Stripe. ArtifactVerify does not store payment card information.

Refunds

Because AI processing is non-reversible, all purchases are final. Refunds are only provided in the case of:

duplicated charges
confirmed technical failures preventing report generation

Refund requests may be submitted to support@artifactverify.com.

5. Uploaded Images & Data Handling

Use of the Service requires uploading photographs of artifacts.

Full Analysis (PointCheck – Full Analysis)

High-resolution images are stored permanently only if you opt in.
Otherwise, high-resolution images are stored temporarily for analysis and then deleted.
Thumbnail images and report data may be retained indefinitely unless you request deletion.

Quick Image Check (PointCheck – Quick Image Check)

Only small thumbnail images and report data are stored.
Retained indefinitely unless you request deletion.

6. Public Verification Pages

Some report data is made available on public QR-linked pages, including:

thumbnail image
authenticity assessment
typology
probability score
SHA-256 hash
report date

Public pages are retained indefinitely unless the user requests deletion.

Deletion requests require:

Report ID, and
Verification Token from the original certificate

This ensures only the rightful owner can remove a report.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

To the fullest extent permitted by applicable law, ArtifactVerify LLC expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including but not limited to:

implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement
any warranty that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components
any warranty regarding the accuracy, reliability, completeness, or timeliness of any AI-generated analysis
any warranty that results will meet your requirements or expectations

No Professional Advice

ArtifactVerify is not an authentication service, appraiser, or professional certification body. The AI-generated analysis does not constitute professional advice, certified appraisal, or expert opinion. You should not rely on the Service as a substitute for consultation with qualified professionals.

AI Limitations

You expressly acknowledge and agree that:

AI findings are probabilistic estimates, not definitive determinations
authenticity can only be confirmed through physical examination by a qualified expert
results may vary depending on image quality, lighting, angle, artifact condition, or AI model limitations
the AI may produce incorrect, inconsistent, or misleading results
public verification pages do not guarantee or certify authenticity

No Guarantees

We make no guarantee that:

your item is authentic or has any particular value
our AI model is correct in any specific instance
buyers, sellers, or third parties will accept or rely on the results
marketplaces (e.g., eBay, Etsy) will honor, recognize, or permit use of our output
the analysis is suitable for any particular transaction or purpose

You use the Service entirely at your own risk and discretion.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARTIFACTVERIFY LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES.

Exclusion of Damages

In no event shall ArtifactVerify LLC or its officers, directors, employees, agents, or affiliates be liable for any:

indirect, incidental, special, consequential, punitive, or exemplary damages
loss of profits, revenue, data, goodwill, or business opportunities
cost of substitute goods or services
damages arising from reliance on AI-generated assessments or analysis
damages arising from any transaction (purchase or sale) of artifacts
damages arising from disputes between buyers and sellers

This limitation applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.

Specific Exclusions

Without limiting the foregoing, we are expressly not responsible for:

financial losses related to buying, selling, or trading artifacts based on our analysis
disputes between buyers and sellers, including claims of misrepresentation or fraud
misinterpretation or misuse of analysis results by you or third parties
changes in market value or collectibility of artifacts
decisions made in reliance on AI-generated assessments
third-party claims arising from your use of our reports or verification pages
any use of our analysis in legal proceedings or insurance claims

Maximum Liability Cap

Our total cumulative liability for any and all claims arising out of or related to these Terms or your use of the Service shall not exceed the greater of: (a) the amount you actually paid to ArtifactVerify LLC for the specific analysis giving rise to the claim, or (b) twenty-five U.S. dollars ($25.00).

This limitation applies to all claims in the aggregate, not per incident.

Essential Purpose

You acknowledge that ArtifactVerify LLC has set its prices and entered into these Terms in reliance upon the disclaimers and limitations of liability set forth herein, which form an essential basis of the bargain between you and ArtifactVerify LLC.

9. Assumption of Risk

By using the Service, you expressly acknowledge and assume all risks associated with:

relying on AI-generated analysis for any purpose, including buying or selling decisions
the inherent limitations and potential inaccuracies of AI-based artifact analysis
sharing AI-generated reports or verification pages with third parties
using analysis results in marketplace listings, negotiations, or transactions
any consequences arising from incorrect, incomplete, or misleading AI outputs

You agree that you are solely responsible for evaluating the appropriateness of using the Service for your specific needs and for all decisions and actions taken based on the analysis provided.

10. Indemnification

You agree to indemnify, defend, and hold harmless ArtifactVerify LLC, its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

your use of the Service or any analysis, report, or verification page
your violation of these Terms or any applicable law
your violation of any third-party rights, including intellectual property rights
any claim by a third party arising from your use of our analysis in a transaction
any dispute between you and a buyer, seller, or other third party
any misrepresentation you make regarding the authenticity or value of an artifact
your use of our reports or verification pages in marketplace listings

This indemnification obligation shall survive the termination of these Terms and your use of the Service.

11. Class Action Waiver

YOU AND ARTIFACTVERIFY LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against ArtifactVerify LLC. If any court or arbitrator determines that this class action waiver is unenforceable, the arbitration agreement (if any) shall be null and void as to you.

12. Intellectual Property

All content, text, UI, code, and design elements of the Service are owned by ArtifactVerify.

Your uploaded images remain your property, but by uploading them you grant us a limited license to:

process them with AI
store thumbnails and report data as described in the Privacy Policy
display them on public verification pages where applicable

This license ends when you request deletion.

13. Prohibited Uses

You may not:

use the Service to create deceptive or fraudulent listings
misrepresent AI results as guaranteed authentication
attempt to access data that is not yours
resell or redistribute our analysis without attribution
use the Service for training competing AI models
upload unlawful or harmful content
attempt to disrupt or overload the Service

We may suspend or terminate your access for violations.

14. Third-Party Services

We use trusted third parties to provide services, including:

Anthropic (AI analysis)
Stripe (payments)
Upstash Redis (storage)
AWS S3 (optional high-res storage)
Vercel (hosting)
Resend / ImprovMX (optional email delivery)

Your data is handled according to our Privacy Policy.

15. Dispute Resolution

Informal Resolution First

Before initiating any formal legal proceeding, you agree to first contact us at support@artifactverify.com and attempt to resolve the dispute informally for at least thirty (30) days. Most concerns can be resolved quickly through informal discussion.

Venue and Jurisdiction

If informal resolution is unsuccessful, any legal action or proceeding arising out of or related to these Terms or the Service shall be brought exclusively in the state or federal courts located in Alabama, United States. You consent to the personal jurisdiction of such courts and waive any objection to venue in such courts.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Alabama, United States, without regard to its conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods shall not apply.

17. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

18. Entire Agreement

These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and ArtifactVerify LLC regarding your use of the Service. These Terms supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written, between you and ArtifactVerify LLC regarding the Service.

19. No Waiver

The failure of ArtifactVerify LLC to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by ArtifactVerify LLC.

20. Survival

The following sections shall survive any termination or expiration of these Terms: Disclaimer of Warranties, Limitation of Liability, Assumption of Risk, Indemnification, Class Action Waiver, Dispute Resolution, Governing Law, and any other provisions that by their nature should survive.

21. Changes to the Terms

We reserve the right to modify these Terms at any time in our sole discretion. If we make material changes, we will update the “Last Updated” date at the top of this page. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Service.

ArtifactVerify LLC is a limited liability company organized under the laws of Alabama, United States.
